can my husband appeal a conviction for dui if it is considered an interstate case? He is a resident of Arkansas, but failed to change his Florida license over and received a dui on the Florida license. However, because of the new CIDLIS we didn't find out about Florida's suspension of his license until 2008. Arkansas saw his dui as his first, Florida is claiming it is his third due to the fact they can go back 10 years. His license is suspended through Florida for 10 years. Is there anyway we can fight this matter. Thanks for any help.

just talked with a lawyer today, dui/dwi can be petitioned for expungement in the state of Arkansas. The down side is that even if sealed, florida would still have the right to view the sealed dui/dwi at the drivers control. the only thing this would help was if you were wanting to get a cdl or job or insurance it would not show up on your record. hope this information is useful to someone else
