Drug Recognition "Experts" aka DR"E"s are not Scientists,.... they are pseudo-"scientists"

One of the lowest paid positions at a hospital are those that hourly take the patient's vital signs. People can be easily trained to take vital signs, no real great accomplishment. I have told future defendants on my website & through emails or phone calls not to cooperate with these DR"E"s ... you have to give a breath sample or a urine sample, if asked , but do nothing else. They have no real background in neither science nor in medicine. Actually, the entire idea is thoroughly based on…See More

In the title above: "4%" should NOT be in the Title.... 4% was not typed in, by me... Also, spell check ability seems to been taken away, from any posting by me. Prof.stan Broskey

When the FORMER state's breathtest "expert" Swore or Certified that the Error was ONLY 5% & the Unit was "R-E-L-I-A-B-L-E",... What did that mean?

It meant that ONLY a 0.084% reading was defendable on a 0.080% Legal Cut Off [since 0.084% times 5% error would make it a potential 0.0798% reading]... that only a 0.042% reading was defendable for a trucker or bus driver stuck with a 0.040% cut off ....that a 0.022% was defendable for a DOT garage worker [or] an Amtrak worker [or] for an underaged drinker/driver in some states with a 0.020 cut off.... or a 0.105% BAC was defendable for an underaged drinker/ driver in other states that have a…See More

Prof. Stanley J.Broskey replied to DUI Cloud's discussion 'Field Sobriety Tests'
The Standard Field Sobriety Tests [ aka SFST] are not based on REAL Science.... you can clearly fail them, even when entirely sober, since you are apt to be under a lot stress when carstopped by the police. The police do not allow you to have any…

Prof. Stanley J.Broskey replied to DUI Cloud's discussion 'Blood Alcohol Content'
Serum Alcohol content as done by the hospital's clincial analyzer can have REAL Error[s] in its finding as no police lab uses this hopsital technology, since it does NOT actually assay for Ethyl Alcohol, itself, but instead assays for a…

Prof. Stanley J.Broskey replied to DUI Cloud's discussion 'DUI Sobriety Checkpoints'
DWI/DUI Checkpoints are PREMIUM police pay assignments ...the NJSP protocol said if a NJSP trooper does not produce results from being on a NJSP DWI checkpoint , he is not be asked back. Doing any SFSTs[ Standard Field Sobriety Tests] are VOLUNTARY…

The Penna State Police is bragging in today's[ 4/8/09] Phildelphia Inquirer that they set a record # of Pa DUI arrests for 2008, namely, 16156 DUI arrests! Up 3% from 2007!! This clearly indicates a lot of room for DUI defense work in…

Profile Information

I am a former forensic chemist/toxicologist for the City of Philadelphia, PA & for the NJ State Police.
I have been doing, strictly, DWI/DUI alcohol or drug defense, since 1970. I testify about the numerous shortcomings of breathtest devices & the shortcomings of alcohol or drug assays in whole blood, serum , saliva or urine . I, also, do the following type of cases: Dram Shop, urine drug cases for job termination or failing probation or parole, underaged DWI/DUI, fatal DWI/DUI, m. v. accident cases involving alcohol or Rx, OTC or street drugs, post mortem drug alc cases, how easy one can fail the police SFSTs or the older roadside tests even when totally sober, how the outward symptoms can be misquoted by the officer for DWI/DUI , Anti-DRE [Drug Recognition "Expert" ] testimony/ rebuttals. I own a lot of breathtesting devices & have used them to show that the DWI/DUI defendant is NOT impaired Nor intoxicated, well above the %BAC cited by the police, due to his /her acquired Tolerance. This is my 51st YEAR in doing what I do, scientifically/ forensically. Breathtest devices are not REAL scientific instrumentation.

This clearly indicates a lot of room for DUI defense work in Pennsylvania. The PSP was not doing breathtesting for about 9 to 10 years after the Pa State Auditor was not goign for pay for this type of equipment but they have gotten back doing this, now, They hope that most people would forget about the former Pa Auditor General by now. drsjb
