If stopped in Massachusetts by a police officer who suspects you may have been operating under the influence of intoxicating liquor or under the influence of drugs YOU HAVE A RIGHT TO:
1. POLITELY refuse to speak with the officer.
2. POLITELY refuse to perform "field sobriety" tests.
3. POLITELY refuse to submit to a breath test.
In Massachusetts, a jury is not allowed, at trial, to hear that the person accused of OUI and related offenses REFUSED to answer questions or submit to either field sobriety tests or breath tests.
